The defense said in the motion that one piece of evidence withheld in the first trial is a video clip showing someone approaching the taillight of Read's SUV while it entered an area at the Canton Police Station on Jan. 29, 2022. Prosecutors didn't provide the defense with that footage until January 2025.

In a motion filed in Norfolk Superior Court, Read’s lawyers said that “by simply ‘dragging and dropping’ files from the Canton Police Department’s Video File System to a USB, the relevant metadata necessary to verify the accuracy, authenticity, and information associated with the creation and storage of that information will be destroyed.”
